On Wednesday, Nov. 6, a man was arrested out of state for a crime that took place in Texas. The felony charge that is currently pending against the man relates to a robbery that happened in Austin. The man who was arrested and accused of the crime is 19 years of age.
The arrest occurred while the accused man was eating dinner at a shopping center. U.S. Marshals had been tracking him since last October; however, it was not until the U.S. Marshals Service contacted an out-of-state Sheriff’s Office that the man was located and arrested. Both deputies and marshals took the man into custody and then he was taken to a county detention facility.
As of Nov. 8, the man was still being held in the out-of-state detention facility in Georgia. Specifically, he was being held on charges of being a Fugitive of Justice. From the out-of-state prison, he was facing extradition to Texas where he will face the robbery charges in court.
State, federal and county law enforcement agencies often work together to make arrests of individuals who are wanted in other areas of the country. The laws within the state where they are arrested will apply to their case initially, though — as here — extradition proceedings may result in the accused individual being returned to the state where the original criminal accusation is pending. Therefore, the criminal defense of their cases, whether they involve a felony charge or a misdemeanor charge, must take into account the local laws of the area where the alleged crime occurred. In the case of federal crime allegations, a legal defense must take into account federal laws and the procedures applicable to them.
