Texas man charged with drunk driving after pedestrian death

A tragic car accident as resulted in the death of a 48-year-old pedestrian. The 71-year-old Texas man who was driving the vehicle in the incident was later arrested by police and charged with drunk driving. Police took him into custody following the incident.

According to police, the 48-year-old man was walking on the side of the road, westbound, when the tragic accident occurred. The 71-year-old man, who was also in the process of traveling westbound, hit the pedestrian at approximately 11 p.m. in the evening. The victim was catastrophically injured and he died at the car accident scene.

It was not until after the 71-year-old man was arrested and brought into custody that police decided he was allegedly intoxicated. The case is still being investigated at this time. It is not known whether or not the pedestrian was attempting to cross the street when the event occurred or if he was walking far away from the path of vehicular traffic.

Because the older man has been charged with drunk driving in an accident that resulted in the death of a pedestrian, the potential consequences could be exceedingly severe if he is convicted of the crime. However, he will not be guilty or convicted until, and only if, a jury of his peers finds him to be so. The Texas driver will have the chance to lodge a strategic legal defense against the accusations, and he may even be able to get the drunk driving charge dropped if there is no sound legal or factual basis for that allegation.
