32-year-old Texas man arrested, charged with drug possession

On Behalf of | Sep 26, 2013 | Uncategorized

Texas police may pull a driver over for a variety of reasons, be it a malfunctioning blinker light, a speeding violation, or a failure to maintain one’s lane. However, in some cases police will choose to search one’s vehicle. This is how many Texas residents find themselves facing drug charges. If and when a police officer alleges that a driver had a controlled substance inside his or her vehicle, they might arrest that person and charge him or her with drug possession.

Recently, a routine traffic stop led to such an arrest in El Paso, Texas. The police allege that they discovered marijuana inside a 32-year-old man’s vehicle. Police say that the controlled substance was found inside a soda cup in his car. They also allege that they discovered marijuana inside a folded subpoena, which was also inside the man’s vehicle. Police also allege that they found 0.1 grams of cocaine beneath the man’s car seat.

The police decided to search the man’s car after they claim to have smelled the odor of burning marijuana inside his vehicle. Ultimately, they arrested him and charged him with drug possession. He was taken to the El Paso County Detention Facility, where he was booked.

Fortunately, police did not accuse of the man have having more than 2 ounces of marijuana, and they did not accuse him of having more than 1 gram of cocaine. Because his drug violation appears to be a minor one, the threat of potential punishments is less severe than it would be if he were accused of having higher quantities of drugs in his car. While no charges of drug possession can ever be taken lightly, with a strategic and intelligently planned legal defense, this man may be able to get some or all of his charges dropped and thereby better his current situation enormously.
